Aurora movie theater shooting day 46: Prosecution to finish cross-examination of expert Dr. Raquel Gur
Prosecution to finish cross-examination of schizophrenia expert Dr. Raquel Gur on day 46 of the Aurora movie theater shooting trial – People vs. James Eagan Holmes. During the course of the trial, prosecutors will argue that Holmes, the admitted gunman, was sane when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colorado, movie theater and opened fire on the audience, killing 12 and wounding 70. His defense attorneys will try to spare Holmes’ life by arguing that he was insane. 7NEWS and TheDenverChannel.com will have gavel to gavel coverage of the trial starting at 8:15 a.m. (MST) everyday and ending around 5:30 p.m. (MST) Watch new live video on our YouTube channel: http://www.youtube.com/user/7NewsDenver/live Additional resources:LIVE VIDEO & BLOG: http://bit.ly/theatertrialTIMELINE of the case: http://bit.ly/theatertimelineJURY PROFILE: http://bit.ly/theaterjury CONTINUING COVERAGE: http://bit.ly/theatercoverage
Legal Question: Why does "not knowing where the question will lead" provide grounds for the Judge to decide to not allow the question? Or am I misunderstanding the statements of the Judge? (I am not being critical of the Judge at all in this question - I love him! - I am just sincerely curious to understand).

QUESTION: Would Dr. Gur's yelling at the jury questions hurt her credibility with the jury?
by Abrandt7/9/2015 10:44:01 PM
In researching a paper for a graduate class, there was a Florida case where the inmate was spared from execution if mentally ill. His attorneys struggled because when he was off the med he was ill. The inmate chose staying on the med and feeling better, rather than going off med and sparing his life. He was executed. Just goes to show how awful the illness is.

It seems to me that Dr. Gur's testimony did hurt the defense. Especially with her arrogance and the lovely quote she said about herself (we all know which one).
Anyway, I also believe that the reason she finds Holmes to be insane is that she herself cannot comprehend that someone who is sane could carry out a massacre such as this one. It seems to me that she believes that someone would have to be insane to commit such a crime. A lot of her answers were contradicting with her testimony.

The four versions of the insanity defense are M’Naghten, irresistible impulse, substantial capacity, and Durham - which one is this case?
by Bob7/9/2015 10:47:07 PM
@FPsych: The defense has at least one more witness and two videos to show before resting. It is expected the defense will rest tomorrow.
by BernerMom7/9/2015 10:47:12 PM
Ooops, I answered the last poll wrong. I meant to say "the gunman is legally sane".

Where do we see the poll results?
by BernerMom7/9/2015 10:48:06 PM
I cant see the results of the last poll, is it because its sticky?
by Abrandt7/9/2015 10:50:51 PM
I believe you have to vote to see the poll results.

@trl2- Which case was that? (I ask because it sounds interesting.)
by Jennifer7/9/2015 10:53:58 PM
I'm 50/50 @Anica
by Goliath_Fish7/9/2015 10:54:00 PM
JH's planning grew out of his psychosis and Dr. Gur understood that. Her experience allowed her to observe the nuance that his planning included his understanding that everyone else shared his worldview and this is what made him insane under CO law. That is what I heard.
by trl27/9/2015 10:54:04 PM
You have to answer the poll in order to see the results, I believe.
by Alison7/9/2015 10:54:10 PM
I did click a vote but then nada
by Abrandt7/9/2015 10:54:11 PM

by Suzi7/9/2015 10:54:15 PM
Tamara is sitting next to Holmes for the first time, wonder what the significance of that is.
by FPsych7/9/2015 10:54:18 PM
Wait…wait…is this advisement pro forma…or does Holmes WANT to testify?
by Clancy7/9/2015 10:54:21 PM
C'mon Holmes--go for it! Testify!
by flip7/9/2015 10:55:34 PM
Judge asks the gunman if he has made a decision to testify - HE WILL NOT. #theatershooting
Court will resume a little late tomorrow - at 9 a.m.
by anica.padilla7/9/2015 10:59:14 PM
I was hoping he would
by Brandi7/9/2015 11:20:37 PM
@FPsych- Tamara Brady was his attorney, you can see that during the first court appearance.
by EZ7/9/2015 11:20:41 PM
I am not surprised.
by BernerMom7/9/2015 11:20:42 PM
The law in CO is right from wrong by law or society standards, nothing else.
by Abrandt7/9/2015 11:20:44 PM
and he is sane enough to make that decisiom
by NT87/9/2015 11:20:47 PM
That is not cowardly- that is smart. It is common for defendants not to testify.
by 5W7/9/2015 11:20:48 PM
I refuse to testify..no kidding lol
by Dennie Carp7/9/2015 11:20:55 PM
Holmes sounded real lucid when answering Judge Samour's questions re: the Curtis Advisement.
by flip7/9/2015 11:20:58 PM
nite everyone, see ya tomorrow
by shuffle7/9/2015 11:21:00 PM

by A.L.7/9/2015 11:21:02 PM
It was kinda creepy hearing his voice. I wish they would have given him a mic.
by Sherrie H.7/9/2015 11:21:04 PM
I don't know about anyone else, but I am glad the nobody will know that Dr. Gur will have testified in this case since, it was not important (in her own words). If only she hadn't felt that way before it took 30 minutes to answer yes or no questions.
