Prosecution to finish cross-examination of schizophrenia expert Dr. Raquel Gur on day 46 of the Aurora movie theater shooting trial – People vs. James Eagan Holmes. During the course of the trial, prosecutors will argue that Holmes, the admitted gunman, was sane when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colorado, movie theater and opened fire on the audience, killing 12 and wounding 70. Legal Question: Why does "not knowing where the question will lead" provide grounds for the Judge to decide to not allow the question? Or am I misunderstanding the statements of the Judge? (I am not being critical of the Judge at all in this question - I love him! - I am just sincerely curious to understand).

In researching a paper for a graduate class, there was a Florida case where the inmate was spared from execution if mentally ill. His attorneys struggled because when he was off the med he was ill. The inmate chose staying on the med and feeling better, rather than going off med and sparing his life. He was executed. Just goes to show how awful the illness is.

It seems to me that Dr. Gur's testimony did hurt the defense. Especially with her arrogance and the lovely quote she said about herself (we all know which one).
Anyway, I also believe that the reason she finds Holmes to be insane is that she herself cannot comprehend that someone who is sane could carry out a massacre such as this one. It seems to me that she believes that someone would have to be insane to commit such a crime. A lot of her answers were contradicting with her testimony.

JH's planning grew out of his psychosis and Dr. Gur understood that. Her experience allowed her to observe the nuance that his planning included his understanding that everyone else shared his worldview and this is what made him insane under CO law. That is what I heard.

I don't know about anyone else, but I am glad the nobody will know that Dr. Gur will have testified in this case since, it was not important (in her own words). If only she hadn't felt that way before it took 30 minutes to answer yes or no questions.
