Aurora movie theater shooting day 46: Prosecution to finish cross-examination of expert Dr. Raquel Gur
Prosecution to finish cross-examination of schizophrenia expert Dr. Raquel Gur on day 46 of the Aurora movie theater shooting trial – People vs. James Eagan Holmes. During the course of the trial, prosecutors will argue that Holmes, the admitted gunman, was sane when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colorado, movie theater and opened fire on the audience, killing 12 and wounding 70. His defense attorneys will try to spare Holmes’ life by arguing that he was insane. 7NEWS and TheDenverChannel.com will have gavel to gavel coverage of the trial starting at 8:15 a.m. (MST) everyday and ending around 5:30 p.m. (MST) Watch new live video on our YouTube channel: http://www.youtube.com/user/7NewsDenver/live Additional resources:LIVE VIDEO & BLOG: http://bit.ly/theatertrialTIMELINE of the case: http://bit.ly/theatertimelineJURY PROFILE: http://bit.ly/theaterjury CONTINUING COVERAGE: http://bit.ly/theatercoverage

Board Certification. You buy it for advertising. I am sure Gur has surpassed the guidelines in her practice of b.c. It is not required.

After a conversation I had with a friend last night, I have changed my opinion on JH's guilt. I believe I was mis-applying what would constitute reasonable doubt. I was thinking if I had even a sliver of a doubt as to his sanity, that counted as reasonable doubt. But my conversation with my friend made me realize that of course there will be defence witnesses who will vouch for his insanity, and therefore, pretty much ANY defence witness could theoretically create a sliver of doubt in me (which I was in turn calling reasonable doubt, and which is not the correct application of the law). He also pointed out to me that its OK for me to set aside any and/or all expert witness testimony, and look at the irrefutable facts in the case. Anyway... just thought I would share the thought processes I have been having with the group in case anyone else is grappling with the issues as I have been.

IMO the guards moving his fingers because he's leaning forward to "do something" while he stretches his back out.
by Kristle7/9/2015 4:10:21 PM
@kate thanks so much.
by Mike7/9/2015 4:10:22 PM
You have to prove yourself in the scientific world through open scrutiny. No one ever becomes beyond questioning. That's how science works. The Doctor should be used to this.

Anyone else notice that King and most of the DT moves the podium to block the view of the jury from seeing JH?
by Victoria7/9/2015 4:10:29 PM
Just be happy we have comments at all, and don't abuse the privilege. If you wouldn't say it to someones face, don't type it. If this little romper room here needs too much babysitting, they'll just shut the whole thing down. Back to the trial kiddos.
by Mark7/9/2015 4:10:31 PM
I think King was mocking GB with the "yes or no" and his tone.
by Jennifer7/9/2015 4:10:39 PM
Don't know that he will welcome your visit. I believe he has indicated that he did this so that he can be in solitary with guaranteed meals and a bed. He wants to be away from people because of his social anxiety disorder and even now often rejects the 1 hour he can go into the common room, even by himself.
by Tammy Garrison7/9/2015 4:10:58 PM
And I love you Anica.
by Tammy Garrison7/9/2015 4:10:59 PM
13 hours of interview with almost no note taking.
by Humble Pride7/9/2015 4:11:06 PM
As long as you don't disagree you can name the i.d. to reference the reply.
by okx7/9/2015 4:11:28 PM
Yes, okx, I do not have a problem with people supporting each other's opinions. Just attacking them. My chat room, my rules.
by anica.padilla7/9/2015 4:12:06 PM
We don't have to agree on ANYTHING to be kind to one another.
by sher7/9/2015 4:13:00 PM
@Alison - Very true. He must be found not guilty if there is REASONABLE doubt. Not just any old doubt. =)
by Angela Freeman7/9/2015 4:13:09 PM
@Alison thanks. I think that is good info to share here.
by MyraJ7/9/2015 4:13:13 PM
this blog used to be a great place for us to come and comment on things related to the trial, now it's just an explosion waiting to happen!
by blue7/9/2015 4:13:16 PM
Don't abuse the privilege. Bravo!! Well said!! Is there a trial on kiddos??
by Kristle7/9/2015 4:13:20 PM
Brauchler, turn on your mic!!!
by colo7/9/2015 4:13:25 PM
I agreed that board certification is not completely necessary, but forsenic training in order to do a better job for courts certainly is, in my opinion. Just like English Composition in High School, it would have taught her how to write a better report, and include things in the report, for trials. (Sorry - trying to type with my painting gloves on today)
by DocJ7/9/2015 4:13:28 PM
In my city those guards get paid over 100k a year...... looks like a job I can do.
by cindy7/9/2015 4:13:32 PM
@Alison Thank you, I guess I to, had the wrong idea about reasonable doubt.
by Humble Pride7/9/2015 4:18:01 PM
I understand that hospitals don't keep ALL scans for a long time, but the one's from a mass murderer? Or in ANY case where there could be foul play involved, wouldn't it be logical to keep that particular scan?
by Sun David7/9/2015 4:18:04 PM
@ Anica, to clarify "My Chat Room, My Rules" (love it!) no personal attacks and no mention of the name that can't be said out loud. JB! : )
by Suzanne7/9/2015 4:18:24 PM
@AM, I am not sure if anyone answered your question about "Defer ruling". It means that the Judge will rule on the admissibility of the exhibit at a later time. He has done that from time to time when he wants to study something or look up prior case rulings, etc.
by BernerMom7/9/2015 4:18:28 PM
And all of that has nothing to do with the time of the shooting. Are we deliberating a psychotic break in November of 2012? No. None of that has to do with mental state on July 20th, 2012. Prove that on July 20th, 2012 he was insane. In my opinion, that has not been done.
by Marsha Laurienti7/9/2015 4:18:39 PM
@victoria - I don't think it blocks the jury's view, but it definitely blocks ours!
by jward127/9/2015 4:18:49 PM
If Holmes was on auto pilot during the shooting.. How did he decide as he stated not to shoot the guy smiling at him because it was too personal?
by qwik draw7/9/2015 4:18:55 PM
Remember.....it isn't over until it's over.
by cindy7/9/2015 4:18:57 PM
The guard seems to be busy with some kind of device
by Humble Pride7/9/2015 4:19:01 PM
Board Certification is highly definitely valued. Dr. Gur marches to her own drummer, both in her credentialing and in the way she practices. Her documentation is not consistent with good clinical practice standards. Regardless of opinion re: guilt, the defendant had the right to experts that better represented his case.
by Mr.D7/9/2015 4:19:05 PM
Here is a thought to deal with the problems going on with chat. If it doesn't have to do with the trial, don't approve the comment. Cleans it up pretty quickly.
by Marsha Laurienti7/9/2015 4:19:21 PM
If only, Marsha! People are staying on topic, but many of us are very passionate about this trial.
by anica.padilla7/9/2015 4:20:13 PM
@caz: LOL!!!! Meester Omes.
by Kristle7/9/2015 4:20:20 PM
what i find interesting is the way they go back and forth about notes vs recording. Cause the jury is taking notes about the case but won't get to look at the recording of the trial in deliberation
by bob7/9/2015 4:20:23 PM
Test
by qwik draw7/9/2015 4:20:26 PM
I forget the estimate of how long both sides thought they would be questioning Dr. Gur today. Are they on their schedule?
by ms7/9/2015 4:20:35 PM
I think its important, too, for the defense to have equally qualified people to support their side. Put aside that I think she must tend to mold every patient brought to her to fit her understanding of schizophrenia. it is still a question that has not been answered as to why the defense didn't get a forensic psychiatrist, unless they couldn't find one that would declare him insane.
by Tammy Garrison7/9/2015 4:20:38 PM
Hey, Mr. King just asked my question!!!
by BernerMom7/9/2015 4:20:42 PM
Other than Gur, did defense present a neurologist about the clinical significance of the MRI?
by Rob7/9/2015 4:20:45 PM
@Cindy, do you live in Guantanamo Bay or Detroit? More than 100K you say? Wow...
by Mark7/9/2015 4:20:55 PM
I'm so glad that this trial has this judge. The judge in the Jodi Arias case could really learn a lot from Judge Samour. IMO
by Resa7/9/2015 4:21:00 PM
Sorry, but I just have to say this.... Mr. King should NOT be wearing pink/peach colored shirts. Us redheads look like we are naked in photos/videos when we do that, and that is certainly not a picture I want in my mind. ;)
