Day 54 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, prosecutors hope to move on to the second phase of the sentencing hearing. The jury has already heard that his parents were concerned enough to take him to family therapy in middle school. And that his mother told dr Fenton he was "always like that". Nothing today has been as credible as that earlier testimony.

I really thought all along this is where the DT would shine...mental illness is a mitigating factor...I really don't understand this approach...show the popcorn bag video, show the $hit smeared cell, show him falling off the bunk...intersperse with this mundane crap...if they don't get this jury thinking fruitcake soon they will emphasize that in the end game he was planning this insanity defense all along and will fall into another PT trap...unless of course, there really is no mitigating mental illness...which I am beginning to believe is possible

stunned they have had 3 years to prepare and gather witnesses.....and this is the defense?......I hope they tie it all together...so far no substance...if anything it has shown him to be "normal"..... I even liked Higgs' opening statement...even though she grates my nerves.....oh boy.....this is serious for the DT

Maybe it's not the DT - it's what they have to work with. I'm not a fan, but I honestly admire them. I considered law school and after a college course that had us attend court, tour jails, work with the police I knew I never could defend some of the people I was exposed to. They are doing their best!

I believe the defense has to do this to try and show his mental state through out his life and when he started to really decline. Thought I would let the people not understanding why they are showing these videos and talking to these witness know why it's being done. but....as @PAWatcher told me earlier i don't belong here, so I'll go for the evening. If I were the defense, I would have gone the opposite and tried to show he was AlWAYS off, a lonely little kid full of anxieties. No real friends. Unhappy home life. Maybe pressured by parents who favored his sister. (Not saying any of this is true, just my theory of defense). And that he was born with schizotypal personality disorder and his parents, school, etc. never got him appropriate treatment. That he only finally got treated in Nov 2012.

@NT8 hi. King is not a mitigation specialist, so he is sitting in the back while Higgs takes over for this part. She is the mitigation specialist on the team.
