Day 54 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, prosecutors hope to move on to the second phase of the sentencing hearing. The jurors requested clarification on the aggravating factor regarding intentionally killing a child under 12. They want to know whether it meant he specifically intended to kill a child, or intended to kill, and happened to kill a child.

They think they have to agree with ALL AGGRAVATING FACTORS!!! I'm tellin' ya...gut feling. That last question sealed it. Otherwise they would have gone with aggravators of 2 sentences for each murder. Someone needs to clarify this...I wonder if Orman sort of blew it? It sounded to me yesterday like he was indicating that all factors must be accepted...'Anyone? Anyone?... 'Bueller?

OK, so maybe Holmes did not intend to kill a child under 12. Veronica just happened to be there. That's reasonable doubt. There are 96 OTHER aggravating factors that apply beyond a reasonable doubt.

Folks, you are really misunderstanding this process with your impatience. Although the jury only needs to agree on one aggravators to move forward, they must duly deliberate and decide on each one of the alleged aggravators. That is so they can later weigh ALL the aggravators against ALL the mitigators.

Pretty clear the hold up is over the intentional murder of a child under 12...the rest are pretty much no brainers but this one may well prove not to apply
