I'm hoping if they get the answer they need, they can return a verdict today.

I just love Judge Samour!
by Abrandt7/23/2015 4:20:56 PM
Groan! Poor jury.
by Frank7/23/2015 4:20:57 PM
Nevermind. I just looked up the link posted by channel 7 of Orman's phase 1 argument. It took all of 40 minutes.
by Susan Eshleman7/23/2015 4:21:02 PM
@Suzanne. I was thinking the same thing. It's almost like hitting the 2 minute warning in football, it still takes 20 minutes to get there :)

key instruction is that you have to sign out first in order to add picture
by Loz7/23/2015 4:21:10 PM
Is there a link for the instructions the Jury was provided for this First Phase?
by Just Thinkin7/23/2015 4:21:16 PM
The note the judge read sounds to me that it favors the DT

believe the jurors will not agree with aggravating factor #2 (Veronica Moser) JH intended to kill and happened to kill child -- didn't single her out
by Mandi7/23/2015 4:21:25 PM
The jurors requested clarification on the aggravating factor regarding intentionally killing a child under 12. They want to know whether it meant he specifically intended to kill a child, or intended to kill, and happened to kill a child.
by anica.padilla7/23/2015 4:23:25 PM
channel 7 what was their questions?
by Happy7/23/2015 4:23:27 PM
They think they have to agree with ALL AGGRAVATING FACTORS!!! I'm tellin' ya...gut feling. That last question sealed it. Otherwise they would have gone with aggravators of 2 sentences for each murder. Someone needs to clarify this...I wonder if Orman sort of blew it? It sounded to me yesterday like he was indicating that all factors must be accepted...'Anyone? Anyone?... 'Bueller?

Don't have several mainstream social media accounts right now=no avatar. :(
by fascinated 7/23/2015 4:23:33 PM
I knew the jurors would get hung up on the intent to kill under 12yrs..
by Dennie Carp7/23/2015 4:23:35 PM
JH said himself he targeted a midnight screening so there wouldn't be any kids there.
by polisalwaysright7/23/2015 4:23:37 PM
Loz-I did sign out, but don't have social media to sign in with. Have to do "quick sign in"- so it won't grab an avatar. :/ But thanks!

by Resa7/23/2015 4:25:37 PM
jward, hows the new baby?
by Happy7/23/2015 4:25:40 PM
@Mandi. but he must have seen all the children in the theater beforehand and still continued on with his plan.
by Bill Ward7/23/2015 4:25:45 PM
But they don't have to accept the child aggravator! They could accept any of the others Orman presented. I love Orman, but I think he miscommunicated!! I really do. :(
by fascinated 7/23/2015 4:25:50 PM
Poor Veronica...oh my goodness...
by Kels7/23/2015 4:25:52 PM
@polisa, I went to an audi dealership the other day which should be filled with audi's, but I still expected to see at least a couple of vw's on the lot. Just sayin... he had to know there would be some
by Loz7/23/2015 4:25:57 PM
Does it really impact the findings if they cannot agree on number 2? Doesn't it have to be that they agree on just one of the factors?
by Suzi7/23/2015 4:26:01 PM
@mandi this is most likely a hang up with the jury...I agree with you
by A.L.7/23/2015 4:26:03 PM
@fascinated They have to decide for each count of first degree murder and every single aggravating factor for EACH count of murder.
by Stacie7/23/2015 4:26:05 PM
I added my AVI. My boat anchored off of Martha's Vineyard
by Tired7/23/2015 4:27:54 PM
OK, so maybe Holmes did not intend to kill a child under 12. Veronica just happened to be there. That's reasonable doubt. There are 96 OTHER aggravating factors that apply beyond a reasonable doubt.
by Frank7/23/2015 4:28:04 PM
As I said yesterday, it seems like a given if they just look at the first one. The one that states that he killed 2 or more in one episode
by Suzi7/23/2015 4:28:06 PM
They only need 1 but I think they are trying to get as many as they can
by Kate7/23/2015 4:28:08 PM
@Happy - he's doing great! I'm short on sleep, but that's par for the course. ;o)

by mama d7/23/2015 4:28:14 PM
Folks, you are really misunderstanding this process with your impatience. Although the jury only needs to agree on one aggravators to move forward, they must duly deliberate and decide on each one of the alleged aggravators. That is so they can later weigh ALL the aggravators against ALL the mitigators.

@Tired, ooooooo look at mr/mrs white colla! Let me know if you need a house/boat sitter!

Loz ---hey dont judge----I worked very hard for that. And I am a Mr.Btw.
by Tired7/23/2015 4:32:49 PM
Sophiamtn@gmail.com I think several of us understand what the jury has to agree on... but I know we appreciate your input for sure!!
by LG7/23/2015 4:32:51 PM
how do I log in from fb? I cant figure it out lol
by emma7/23/2015 4:32:54 PM
Could they, hypothetically, agree on at least one factor for each victim but not be unanimous on any of them?
by Suzi7/23/2015 4:32:57 PM
Pretty clear the hold up is over the intentional murder of a child under 12...the rest are pretty much no brainers but this one may well prove not to apply
