Day 54 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, prosecutors hope to move on to the second phase of the sentencing hearing. Sophlamtn, where do you get that from? We haven't heard that so far. Is there law for this? Because the judge read in the jury instructions said they had to agree on only 1 aggravating factor. That's why both sides expected it to go so fast. So if you know something we are missing, please explain and help us all.

I have to go soon...I'll look forward to reading this later. Something tells me this equals LWOP. (Just hope it's in general population.) I think they clearly misunderstood and think all aggravating factors were needed for a unanimous agreement- not just ONE factor. They already agreed on one factor in the way they found him guilty. I hope I'm wrong, & could well be...But why do this if they understand only ONE needed to be agreed on? It didn't have to be Veronica. It could have been in "intent to kill more than one person in the act". That's it! Re-read the list of aggravating factors. Read Frank's remarks. I love Orton, but between laborious instructions and his passion in presenting, the basics were lost. :(

Is there a way to play the video from yesterday when the judge specifically explained the verdict form so the people here can understand what the jury is deliberating on? People do not seem to understand that the jury can decide on one but not the other but they have to decide on EVERY single one for EVERY count

If what some are saying is correct- which they may well be -why did both DT and PT AND JUDGE expect to go into next phase yesterday, with mitigation witnesses who aren't flexible, just waiting to testify? Why didn't DT make a rebuttal?? It doesn't make sense. I don't propose to understand it fully, but I think Frank's comments arr right on...

Phil just gave a great explanation of what the jury has to do - discuss ALL 5 mitigators as directed by the court. They may not all agree on all 5 but their discussions are preparing them for the next phase when mitigating factors are presented and they WEIGH them against the aggravating factors! Thanks Phil for clearing it up for us!

So when the final scales are weighed by the jury, Veronica's life will weigh the same as the other 11. I don't think that changes the calculus much. It does remove the injection of emotion which is natural in the death of a child, although the jury will have her picture in front of them. Culling out that emotion will be an impossible task, especially for the parents on the jury.
