CU psychiatrist Dr. Lynne Fenton is expected to testify on day 32 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. During the course of the trial, prosecutors will argue that Holmes, the admitted gunman, was sane when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colo., movie theater and opened fire on the audience, killing 12 and wounding 70. Part of Brady's direction includes working in the fact that "JH came in to the clinic talking about wanting to kill people" as many times and ways as she can.

Dr. Fenton said during her first meeting with the gunman, he had "frozen nervousness" - he was very still and not fidgety. "He didn't really show any emotion in his face."

Suzanne. I can't listen bcz I'm at a conference, but defense is asking the questions and Dr. Fenton says the gunman told Margaret Roath that he couldn't tell her any more or she would "have to report him."

@Monique J: The plain and totally simple answer I believe is: A lot of people are mentally ill but still know right from wrong in some way. Insanity is not having the capability of knowing right from wrong.

Well, I don't know if it really helps them very much, but I assume the DT wants the jury to hear as much evidence as possible that makes JH seem psychotic at the time.

The calendar is for the jury! Let them piece it together in deliberations. Looking at the calendar I think would help me put 2 + 2 as far as reaching out for help.

She sure is making him sound psychotic. She still didn't have enough to write a hold, but she is not testifying well in my opinion. It wasn't her fault, certainly not implying that, but remember the jury is the one making the decision and if I were on that jury this testimony would put a "reasonable doubt".

I think Mr. Edson fills a very important role on the PT. In front of the jury, he takes on lots of the more tedious or potentially annoying portions of the prosecution's case thereby allowing Mr. Brauchler, Mr. Orman, and Ms. Teesch-McGuire to maintain really positive relationships with the jury during their direct examination of the most compelling witnesses. I find it fascinating the way the PT breaks up their responsibilities and roles...wonder if the Ch7 legal consultants might like to comment on strategic assignments within the PT.

@7 can you please ask the legal analyst why many of the hearsay objections that have been sustained why? it seems to me that these are admissible under 803 (excited utterance) - I think all of the statements made to each other in the theater would qualify under that.
