Aurora movie theater shooting trial day 34: CU psychiatrist Dr. Feinstein to return to the stand
Day 34 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, CU psychiatrist Dr. Feinstein will return to the stand. During the course of the trial, prosecutors will argue that Holmes, the admitted gunman, was sane when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colo., movie theater and opened fire on the audience, killing 12 and wounding 70. His defense attorneys will try to spare Holmes’ life by arguing that he was insane. 7NEWS and TheDenverChannel.com will have gavel to gavel coverage of the trial starting at 8:15 a.m. (MST) everyday and ending around 5:30 p.m. (MST) Watch new live video on our YouTube channel: http://www.youtube.com/user/7NewsDenver/live Additional resources:LIVE VIDEO & BLOG: http://bit.ly/theatertrialTIMELINE of the case: http://bit.ly/theatertimelineJURY PROFILE: http://bit.ly/theaterjury CONTINUING COVERAGE: http://bit.ly/theatercoverage

If people take issue with the docs not doing enough, take it up with medical boards. They are following the rules that those boards set up. HIPAA rules are very specific, of which, Fenton broke the rule and risked her license trying to go above and beyond. Psychiatric holds are very specific in order so that doctors don't overstep their bounds. If you take issues with why the docs couldn't do more, don't take it to their doorstep, take it to DORA (Dept of Regulatory Agencies).

Thought he had four guns
by deb6/18/2015 10:46:40 PM
@NH---"@flip - think you misunderstood my tone." Naw, I was just joking with you, NH, that's what LOL is for...
by flip6/18/2015 10:47:27 PM
He bought 2 at once. I think it was at Bass Pro that he got the AR-15 & a glock, but I'm not possitive.
by Tammy Garrison6/18/2015 10:50:32 PM
@DocJ So sounds like he was just checking the DR. off the list like buying a gun or ammo
by bob6/18/2015 10:50:34 PM
Holmes bought an AR-15 rifle, a Remington 12-guage 870 shotgun, and two 40-caliber Glock handguns.
by CindyL6/18/2015 10:50:39 PM
@flip O_o Bad joke. Wouldn't want to date her. Her flying hand gestures might whack me during a conversation.
by NH6/18/2015 10:50:44 PM
surprised that Gander Mountain doesn't have video camera at gun sales counter
by mandi6/18/2015 10:50:47 PM
@Marsha - I agree with you. It is starting to appear, however, that the defense is going to try and say it was the doctor's fault that JH was at-large and able to commit these murders.
by DocJ6/18/2015 10:50:52 PM
That lawyer and her little microphone box on her hip is annoying. Just speak into the one in front of you. Geez.
by Marsha Laurienti6/18/2015 10:50:57 PM
@Flip Are you a Dr.?
by Sally Mander6/18/2015 10:50:59 PM
Jurors are being released a little early today. Leaving court now.
by anica.padilla6/18/2015 10:51:25 PM
I find Ms. Higgs' continual gesticulation distracting. I can't tell if she is trying to swat bugs or bring a plane into the terminal.
by Katatt6/18/2015 10:52:37 PM
It's a poor defense. The rules set up by the State back their actions.
by Marsha Laurienti6/18/2015 10:52:40 PM
@Sally--I've got a PhD, not an M.D.
by flip6/18/2015 10:52:43 PM
@Flip...thanks, I thought so
by Sally Mander6/18/2015 10:57:24 PM
I'm thinking we already saw a video of the gun counter at Gander Mountain.
by Tammy Garrison6/18/2015 10:57:25 PM
King is ready to go again! Lol
by Suzanne6/18/2015 10:57:26 PM
@Flip...PhD in what, If you would like to share. (Just asking)
by Sally Mander6/18/2015 10:57:27 PM
@Marsha - true, but the jury is not allowed to go home and look up a reasonable explanation and examples of a mental health hold like we are.
by DocJ6/18/2015 10:57:28 PM
@flip, so with just a phd you cant prescrinbe medication.... hmmmmmm is your phd in psych?
by NT86/18/2015 10:57:29 PM

Any questions for the legal expert?
by Phil Tenser6/18/2015 10:57:40 PM
King is ready to go! He does this everyday, packs his bag and hustles out the door
by Victoria6/18/2015 11:11:05 PM
@Phil - would like to know more about jury deliberation process if no other question comes up. Like about what alternates do and how much evidence will they review again? Can they ask for further clarification on anything. Etc.
by NH6/18/2015 11:11:06 PM
@doggett---rotflol...@Sally & NT8, my degree is in a physical science that is not related in any way to the subjects of this trial. My opinions are strictly arm-chair quarterbacking and not based on professional expertise. And, I've ever claimed differently, NT8)
by flip6/18/2015 11:11:07 PM
Higgs is ready to go too.
by Kristle6/18/2015 11:11:09 PM
Legal Question - appropriate for release juror to be in court, regardless of it legal?
by DocJ6/18/2015 11:11:12 PM
What's the definition of "hearsay"?
by Bevvie6/18/2015 11:11:13 PM
@DocJ, I remember hearing the jury given the list of reasons why a hold can be put on a person.
by Marsha Laurienti6/18/2015 11:11:15 PM
For Legal - how would you handle the Ashley Moser questioning?
by DocJ6/18/2015 11:11:17 PM
@Phil: I asked about detective homework on juror conversations with coworkers but.....
by Stephany6/18/2015 11:11:18 PM
Qu: Will Fenton be called by the defense? If not why not? Also how will the impending law suit against Fenton and the University be affected by the results of this trial?
by Unique_19856/18/2015 11:11:20 PM
king's a busy guy apparently. better things to do.
by doggett6/18/2015 11:11:23 PM
to legal dude: what could be the discipline given for the things you were talking about earlier re: discovery??
by doggett6/18/2015 11:11:23 PM
Lol doggett, I'm laughing so hard
by TS6/18/2015 11:11:24 PM
I think both Drs. Fenton and Feinstein had to be very careful of their answers due to the pending lawsuits against CU, which did not help their appearances in this proceeding.
by Katatt6/18/2015 11:11:25 PM
Can the emails comes back in if redacted?
by Tammy Garrison6/18/2015 11:11:30 PM
@bevvie law def: the report of another person's words by a witness, usually disallowed as evidence in a court of law.
by sydnijmm6/18/2015 11:12:53 PM
Both Dr.s have a legal obligation not to overact with clients or they can lose their licenses!! I know this personally.
by Js6/18/2015 11:16:04 PM
the redaction email question was for legal beagles too.
by Tammy Garrison6/18/2015 11:16:06 PM
In my opinion only, I think Ashley Moser's limitations regarding what she can and cannot say regarding the events of the shooting and the results of her injuries are far more restrictive than any other victim and that bothers me. I understand the prejudicial problem for the defense, but their client went into a theater and shot a bunch of people. Gunshot wounds, in her case, left her with lasting and devastating effects. She should have the right to discuss what happened to her.
