Aurora movie theater shooting trial day 35: Survivor Ashley Moser to testify
Prosecutors have said they will call survivor Ashley Moser to testify on day 35 of the theater shooting trial - People vs. James Eagan Holmes. During the course of the trial, prosecutors will argue that Holmes, the admitted gunman, was sane when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colo., movie theater and opened fire on the audience, killing 12 and wounding 70. His defense attorneys will try to spare Holmes’ life by arguing that he was insane. 7NEWS and TheDenverChannel.com will have gavel to gavel coverage of the trial starting at 8:15 a.m. (MST) everyday and ending around 5:30 p.m. (MST) Watch new live video on our YouTube channel: http://www.youtube.com/user/7NewsDenver/live Additional resources:LIVE VIDEO & BLOG: http://bit.ly/theatertrialTIMELINE of the case: http://bit.ly/theatertimelineJURY PROFILE: http://bit.ly/theaterjury CONTINUING COVERAGE: http://bit.ly/theatercoverage
Ashley lost two children on the same day and around the same time. She lost some of her ability to function in many of her daily activities. And there is further pain and loss that we many not now about. I hope she is able to heal more and perhaps get off O2. It was powerful when AC said, "THE PROSECUTION RESTS!"

If I was the defense I'd be throwing up right now....JH deserves the death penalty!
by Tammy6/19/2015 8:44:31 PM
You're doing a great job, Anica. We all love you for it.
by DocJ6/19/2015 8:44:33 PM
And to add to the stats, How many times I wanted private time with jh its over 20
by NT86/19/2015 8:44:37 PM
Okay, this is my first trial so I think I was expecting a "tying it all together" session. Is that just movie trials and here they just present a crap ton of evidence and expect the jury to tie it all together?
by Stephany6/19/2015 8:44:45 PM
Stephany I think your talking about closing arguments. That happens after the defense rests.
by Tammy Garrison6/19/2015 8:47:15 PM
Did he just say ACQUITAL!????!!!! OMG
by DocJ6/19/2015 8:47:16 PM
they will tie together and connect the dots in closing arguements
by debitwo6/19/2015 8:47:22 PM
NT8. Can I go in with you?
by Hill6/19/2015 8:47:23 PM
@Tammy G. I would imagine it is hard for him, poor guy.
by MJ6/19/2015 8:47:25 PM
@Stephany Each side presents a closing argument after all of the evidence is presented.
by Lori Butterfield6/19/2015 8:47:26 PM
@ Trinity- Usually the whole thing from beginning to end is 9 hours. But I believe this would be 6 hours for today. I'm not sure how long Ashley Moser's testimony is, though.
by EZ6/19/2015 8:47:28 PM
That occurs in closing arguments, at the conclusion of all evidence by both sides.
by Rusty6/19/2015 8:47:29 PM
closing arguments tie it all together
by texas6/19/2015 8:48:23 PM
@Stephany...closing arguments! :)
by Tammy6/19/2015 8:48:24 PM
There are closing arguments at the end of the trial when the defensive rests, I think.
by MM6/19/2015 8:48:25 PM
There's no way he would be acquitted? Right??
by Hill6/19/2015 8:48:26 PM
yall have no idea how I despise JH- that sweet little girl and the angel baby- and all the people he affected for WHAT?
by chess6/19/2015 8:48:27 PM
IT would be hard for anyone. Wonder if he has kids of his own.
by Tammy Garrison6/19/2015 8:57:57 PM
Y'all know I cain't spell, right? lol
by DocJ6/19/2015 8:58:00 PM
@EZ I actually meant like how long before uploaded to youtube?
by Trinity6/19/2015 8:58:01 PM
@DocJ: the sheriff's deputies are watching everyone.
by McGruber6/19/2015 8:58:04 PM
Ahhhh, thanks guys! My Cousing Vinny is not the best reference for court proceedings!!!
by Stephany6/19/2015 8:58:07 PM
@DocJ---I think a motion for acquittal from the defense is basically automatic at this point in this type of trial. NGH-- Not. Gonna. Happen.
by flip6/19/2015 8:58:12 PM
acquittal isn't even an option!!
by Tammy6/19/2015 8:58:14 PM
There's no way he'd be acquitted.
by Ruby6/19/2015 8:58:16 PM
@Hill highly highly doubtful
by MJ6/19/2015 8:58:19 PM
An acquittal should not be carried out!!!!
by Tjq6/19/2015 8:58:20 PM
Question for Legal Beagle: What the French Toast is this talk of acquittal?
by DocJ6/19/2015 8:58:26 PM
That was such a great question. Did you walk into the movie theater that night.
by Tammy Garrison6/19/2015 8:58:30 PM
Chess.. He gets to be 13 now. That's for what. He needs to be put to death. NOW
by Hill6/19/2015 8:58:34 PM
I believe the motion for acquittal is more for the record for appeals if he is sentenced to death. The defense has to show that they did their job by basically tossing it to the judge at this point. They will give the judge a chance to say that the PT's case had no merit and acquit the defendant right now. I imagine that motion will be denied!
by Lori Butterfield6/19/2015 8:58:40 PM
My heart just breaks for Ashley Moser.
by Katatt6/19/2015 8:58:42 PM
thank goodness the DT didn't cross examine. that would have been too much
by thank goodness the DT...6/19/2015 8:58:44 PM
@ Phil: Please ask your legal consultant what the confusing legal motion means,
by Keeter6/19/2015 8:58:50 PM
PT got in all that they wanted I think in reference to what the wanted AM to talk about on the stand
by LG6/19/2015 8:58:57 PM
Everyone have a great weekend! I will keep the victims in my thoughts. We are very blessed everyone.
by MJ6/19/2015 8:58:59 PM
@MM - PT will have a rebuttal case after the DT puts their case on - then closing statements
by mandi6/19/2015 9:02:22 PM
all defense teams make a motion for acquittal when PT ends its case
by debitwo6/19/2015 9:02:24 PM
As awful, as horrific as this terstimon and this act are, could we please refrain from sounding like a brutish lynch mob on this chat? Fury is understandable. But these sorts of posts are exactly why the law exists.
by LB6/19/2015 9:02:31 PM
@Marshall and Phil---thank goodness the PT gets rebuttal after the DT rests.
by flip6/19/2015 9:02:34 PM
I like Phil's other ties better. :)
by DocJ6/19/2015 9:02:36 PM
Defense makes motion for acquittal. Claims prosecution did not prove their case.
by anica.padilla6/19/2015 9:04:25 PM
@legal beagle, What is your take today? even after what Rick said yesterday?
by NT86/19/2015 9:04:28 PM
@ Trinity- Oh, I apologize. I think somewhere between 9pm or 10pm. It depends. Sometimes it's uploaded at 9, sometimes at 10. I wish I had an exact answer, but I do remember seeing these uploaded around 9-10 pm.
