Aurora movie theater shooting trial day 35: Survivor Ashley Moser to testify

Prosecutors have said they will call survivor Ashley Moser to testify on day 35 of the theater shooting trial - People vs. James Eagan Holmes. During the course of the trial, prosecutors will argue that Holmes, the admitted gunman, was sane when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colo., movie theater and opened fire on the audience, killing 12 and wounding 70. Don't think I'd want to be a public defender. In almost every case, you start behind. Prosecution doesn't go to trial unless they are very sure they can win.

The Defense Show is going to be very interesting...less than two weeks before the shootings he is "okay"...his demeanor doesn't change according to the three people that seem to know him best (Gargi, Ben and, now Hillary)...he's a methodical planner (maybe even planning his own insanity defense) and even during the shooting clearly aware of his surroundings (smiling guy)...the noose is slowly tightening...the insanity summit is clouding over and may be closed by the time the defense tries the final ascent...JM2CYMMV

Something notable about these mentally ill types, i.e., schizoid and schizotypal personality disordered, they take things from other people and incorporate them into their own selves, i.e., hair color, the way people act, and respond, talk. Also, him believing that he and Hillary were "dating", for him going on a hike is considered a date in his mind, it makes him feel good about himself to think he is dating someone like this, although that was absurd, and she made it clear that "I didn't want him to think this was a date", because she had no interest in him in that way at all. His perceptions of what is real, are very clouded, and his judgement is very OFF. If she was interested in him, no matter how busy she was with school, she would have found a way to go out with him again, but she was extremely disinterested in him, and geez he is gross!

I imagine there will be some cross....but the DT will have to tread lightly with Ms. Allen. She is open, engaging, bright, candid--all the things the DT must be wishing that she wasn't. No obvious toe-holds for the DT here.

@Suzanne...they can be used in the sense of providing guidance but they are not in and of themselves precedential...typically there are three levels of courts in every state...trial, mid level appellate and supreme court...their rulings are binding on those below but not those above...thus the supreme court rulings are binding on the mid level appellate courts and trial courts...the mid level is binding on the trial court but not the supreme court...trial court rulings are the lowest level decisions and are, typically cited only when higher level opinions do not exist but they can offer guidance to other trial courts...hope that helps.
