Aurora movie theater shooting trial day 35: Survivor Ashley Moser to testify

Prosecutors have said they will call survivor Ashley Moser to testify on day 35 of the theater shooting trial - People vs. James Eagan Holmes. During the course of the trial, prosecutors will argue that Holmes, the admitted gunman, was sane when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colo., movie theater and opened fire on the audience, killing 12 and wounding 70. @okx--I get it that you can't understand the rationale for death sentence. In my view, a successful execution of James Holmes would permanently delete this hideous, brutal murdering criminal from society. Life imprisonment does not necessarily provide that benefit to society....lifers without parole nevertheless have ways of continuing to interact with society, make news, influence fellow prisoners who may be released back into society, etc, etc, etc. Death is permanent, and would be a just outcome for Holmes IMO.

Plus, sitting in prison is what he wants. And I say again that the victims and family members should have some say in what they want the outcome to be. I don't know who said it, but this is not about him, this is about those victims and the family members. This is about justice for them.

JC, from my knowledge of previous case participation, they are, but those pads are taken up at the end of the trial and go into the evidence box. Learned at "Citizens' Police Acadamey" that every piece of evidence, including cars, from murder trials are kept and stored forever.
