Aurora movie theater shooting trial day 35: Survivor Ashley Moser to testify

Prosecutors have said they will call survivor Ashley Moser to testify on day 35 of the theater shooting trial - People vs. James Eagan Holmes. During the course of the trial, prosecutors will argue that Holmes, the admitted gunman, was sane when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colo., movie theater and opened fire on the audience, killing 12 and wounding 70. everyone has said for the last 35 days that ashley will be last. even kristle has chimed in on that. Hotmail guy will be second to last they said.. meaning ashley will be last.

Back to Fenton for a minute. She isn't on trial, but if the meds escalated thoughts into actions via a psychotic episode. wouldn't that period of time be enough to provide insanity? Also, how will that be disproved?

I understand that the medications sedate JH profoundly but I haven't seen him w a tissue shedding one tear about the testimony of any of his victims - shocks me!

@okx--You raise an important point. It seems to me very likely that the DT will try to plant doubt as to the possible role of psych meds in the Holmes' massacre. I am not aware of any proof that psych meds can induce someone to murder, or that Holmes' specific psych meds caused him to lose touch with reality; however, that certainly doesn't mean that the DT won't try their best to insinuate these kinds of things.

Please remember they jury has to judge him ONLY the evidence not the emotional part... PT has had several emotional witness on the stand already staring with the 1st one Caleb, the officer who cared VM out...etc

@7 - what is the difference between being able to cases that the accused is unable to stand trial and this one, i.e. JH pleading insanity. If he was insane, wouldn't he be unable to stand trial? Or was he insane JUST during the event (or is that what the DT is claiming?)

@NT8--"Chief Magistrate James Gosnell said he did not have authority to grant suspect Dylann Roof bail on the murder charges but set a bond of $1 million in a weapons charge."

I saw this and didn't understand exactly what it meant. But, bottom line is: No bail for Roof, based on the murder charges.

Update on the SC shooter, the preliminarry hearing 1 million bond is only for the gun charge, The murders will be the next bond hearing in Circuit court.

Hey everyone, I haven't been able to follow he last few days live and I am trying to catch up but I wanted to see Ashley Mosher take the stand. Im a mom of three and I truly don't want to see it but that little girl deserves more respect then the court is giving her in my opinion.
