APD Det. Gary Rivale said the gunman made odd movements with his hands when they were in paper bags to preserve gunshot residue. Rivale said it was like he was playing with puppets.

Why isn't the defense asking more in-depth questions about Holmes' weird behavior? They're not really going into anything at all. You'd think they'd want to really focus on that, you know, since they're trying to defend him for insanity and all.

Q: Why was Dr. Weintraub qualified by the court as an expert witness?--It seemed as though he was a treating physician. What are the rules or guidelines on this?

Another Q for legal: The PT allowed a defense witness to characterize a "smirk" by Holmes at his 2011 job, even though "smirk" was successfully objected to by the defense during a jail guard's testimony for the prosecution. Any significance to this?

@wp---not very likely to hear from the parents during the guilt-phase of the trial. We will surely hear from one or both of them for mitigation during a sentencing phase, if there is one.

They keep calling all these doctors that spent so little time with JH. I just do not understand what they think they are going to accomplish by that when those other doctors spent way more time with him.

@Victoria--the November 2012 hospitalization is the closest the DT can really come to demonstrating that JH did actually have a real psychotic break from reality. They of course want to provide as much linkage as possible between the November psychotic event and their theory that Holmes was also psychotic during the theater shooting.

Now will the DT ask how much time he spent with jh. Bet not, that will come out from the PT as usual.

DT feels that calling many drs. from the November incident will convince the jury of JH's mental state during the shooting, Woodcock certainly didn't help their case IMO

@Tammy--I think below the surface there is a possibility that the DT may have had more pyschiatrists meet briefly with Holmes than they are actually going to call into court. For instance, if the DT hired Dr. X to speak with Holmes for an hour or two, and then Dr. X told the DT "In my opinion, he may have been sane when he shot all of those people"....well, the DT is absolutely not obligated to use that witness, nor would they (unless THEY wanted to be locked up for insanity....LOL). So, bottom line is, they are using whatever witnesses they can who can lend some support to their theories.
