Day 2 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, prosecutors open their case calling witnesses _____? During the course of the trial, prosecutors will argue that Holmes, the admitted gunman, was sane when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colorado, movie theater and opened fire on the audience, killing 12 and wounding 70. I am surprised to see people commenting that Dr Gur is a liar, answering questions to fit her agenda, and calling her report a sham, all based on seeing a few hours of her testimony. We are all entitled to our opinions of course, but it seems to me that none of us have read her report. Of course, the prosecutor will be doing his best to make her appear in the worst possible light. Given this, I would have hoped people would have a more open mind before accusing her of being more than unprepared or under pressure.

The purpose of this trial is to determine sanity of Mr. Holmes, not to advance knowledge of mental illness. There are other venues for that

Isn't it interesting that Dr. Gur can "understand" what JH 'meant', but not understand GB's direct questions? Also, anyone notice that her accent becomes heavier when she says she doesn't "understand" GB?

In some ways, isn't it disappointing that the defense hasn't presented a better case? We, as taxpayers, will have to pay to retry if he is found guilty and then appeals shows that the defense was inadequate. Isn't that how it works?

@lawdog - This has everything to do with her opinion. If she arrived at it based on inaccurate information/assumptions, then her opinion is seriously flawed. He has the burden of proving that with painstaking detail or he wouldn't be proving his case beyond a reasonable doubt.

so his point is : She already had written her report and said that he was insane "before" she had gone over almost all of this stuff with JH. So Really only her first report is what matters. That is where she made her judgement.

I actually compassion for the DT. It has to be extremely challenging taking on a case like this. Mentally dealing with a death penalty case that has so few viable defense options to pursue must be a terrible burden.

The doctor is too busy defending and not answering questions which makes her look defensive and less than accurate. But Brauchler has certainly made some important points in terms of what questions were NOT asked and therefore making her report look inadequate. I still do not see legal insanity. As a matter of fact I think the doctor has already made it clear through Brauchlers examination that JH was NOT legally insane at the time of the crimes

It is largely meaningless to tally objections made during trial, i.e. they have no bearing on who is "winning." For the most part, they are interposed to preserve matters for appeal.

@LawDog: Those of us who have been here from the begining find it informative to have a count of the objections and the over ruled and sustained. These things flew so fast and furious at the start that we could not always keep up. Now it is just a fun fact. We are aware we are not a jury, that many do not believe any of us should be jurors, and that 99% of us are not lawyers. Relax.

@Edy - everytime King indicates mis-states the evidence, the Dr. says "Will you repeat the question?" Seems almost as if he's telling her to be cautious with her answer....
