Closing arguments in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Tuesday, attorneys will be presenting their final statements before the jury begins to deliberate if the gunman was guilty or not guilty by reason of insanity.

@Annie...I have to tell you, I have no dog in this hunt...no one I know was involved...I don't live in CO though I have close friends that live in Denver and Kremmling...I came into this thinking Holmes was crazy as a loon...like fruitcake crazy...I mean what sane person does $hit like this...but I have to tell you, having now heard the evidence...I feel bad for him he was socially awkward, has a self described small penis and couldn't connect with girls...but he knew (IMHO) exactly what he was doing and, I believe, planned his own insanity defense...yes, he's mentally ill, no doubt, but he is not, IMHO, legally insane.

@Annie, I'm with you, too. And I am commitedly in the camp that the death penalty is not a choice. Punishment, yes. LWPOP, absolutely. But not the other. Not ever. I expect that the attacks will start flying through the comment thread now...

The process is what I am most interested in. Different judges, their styles, Def and Pros, all if it is an education in how our legal system really works. Thank goodness there are judges who believe in total openness in so far as allowing cameras. Rape is the only time I think any witness should NOT be shown. Truth, in all forms, is the ultimate goal. How we get there is the what interests me most.

Yeah, not sure that taking someone elses life for killing other people is really doing any kind of justice, seriously it is just perpetuating more violence, which we certainly don't need. I believe that putting this guy in prison for the rest of his life, without ever being released, is the worst possible outcome for him, because he will have to deal with himself, and deal with the flashbacks of what he has done, for the rest of his life, that is the worst thing you can do to him!

These days the death penalty is LWPOP in our state. Look at Dunlap! Another coward just like this one. I would still go for death penalty, make it a potential start to a cultural change. You kill someone, or 13, we kill you back. No more burdening prisons.

that's why this is up to the jury and not a forum on a news site. the state of colorado believes (for now) that the death penalty is appropriate punishment for first degree murder. but the jury doesn't have to choose it. they can find him guilty and not punish him to death. it's out of our hands.

One of the jury instructions was very clear - the jury is not to consider the punishment for Jimmy's crimes at this point in time. Save the death penalty debate for another day.

Hang in theere clancy and Me. Its been this way since Day 1. Very frustrating,ecause some of the huge determinants are in denial. Its a critical mind thing, I believe, All is not well and no intention of healing by considering unfamiliar possibilities within the diseased brain, that can blindness of consciousness.
