NOTE: THE "SCHEDULED" START TIME OF THIS CHAT IS SIMPLY A PLACEHOLDER. THERE IS NO INDICATION OF WHEN THE JURY WILL REACH A VERDICT, UNTIL THE COURT ANNOUNCES IT IS DONE. Jurors in the Aurora movie theater shooting trial will alert the court after they reach a verdict in each of the 165 counts in the trial of the People v. James Holmes. Holmes is accused of killing 12 people and wounding 70 others in a mass shooting inside an Aurora movie theater on July 20, 2012. He has pleaded not guilty by reason of insanity. I think the 2nd degree charge may have been for someone in theater 8.
by DocJ7/16/2015 10:41:32 PM
Because of his mental illness, not insanity, I think LWOP is the appropriate sentence. Although I am not against the death penalty.I hope he can stay on meds in prison.
by Ann7/16/2015 10:41:33 PM
Thank you D7 for your outstanding news coverage and letting the judge read the entire verdict on the TV without interruption. ALL victims deserve such respect!
by Just Thinkin7/16/2015 10:41:34 PM
see that 3 2nd degree's now, right??
by colo7/16/2015 10:41:35 PM
I wonder if JH will begin have more videotaped psychotic breaks/outbursts in his prison cell, now that death penalty is on the table...(*whether they'd be real, as a result of the impact/stress of this verdict, or staged, as manipulation to appear "more escalated" in non-legal insanity)...Would that even be admissible evidence, any law experts out there...???
by fascinated 7/16/2015 10:41:37 PM
Were the victims of the lesser 2nd degree charges in theater 8 instead of 9? That might make sense.
by NH7/16/2015 10:43:35 PM
@NH: That may be correct. We're checking and comparing to confirm
by Denver77/16/2015 10:43:48 PM
Since he has been determined that he is guilty there now will be a second trial to determine if he will spend life in prison or death penalty they will not determine that today.
by lovelyrose7/16/2015 10:43:49 PM
What is the difference between 1st and 2nd??
by FMM7/16/2015 10:43:50 PM
Was Zach Golditch in Theater 8? Maybe that's why it's a 2nd degree?
by Victoria7/16/2015 10:43:51 PM
That makes sense, Edy, thanks...
by fascinated 7/16/2015 10:43:52 PM
Due to his mental illness, no chance he gets the death penalty. This is where the jury will draw the line.
by Danny7/16/2015 10:43:56 PM
I'm wondering if the 2nd degree attempted murders were victims that were in Theater 8?
by flip7/16/2015 10:43:57 PM
@Ann, the defense already tried to do a plea bargain that was LWOP, anything less than DP means the trial was useless
by Just Thinkin7/16/2015 10:43:58 PM
the gunman is going to HELL.THANK YOU TO THE JURY :)
by nicky lup7/16/2015 10:44:00 PM
I dont get how people do not understand reasonable doubt the crime was horrible but im sorry i disagree
by charles lizotte7/16/2015 10:44:01 PM
Wonder what is up with these 2nd degrees?
by Ann7/16/2015 10:44:01 PM
I hope he gets life, and I hope he gets help while in prison, though that's seldom how things work out.
by Angela Freeman7/16/2015 10:44:02 PM
maybe the 2nd degrees were minors?
by Brenda Cash7/16/2015 10:44:31 PM
@docJ I think your right and makes sense...
by Tired7/16/2015 10:44:32 PM
DocJ--I just saw your comment after reaching the same conclusion. I think you may be right...what other explanation makes any sense?
by flip7/16/2015 10:44:33 PM
Hubby said that JH was laughing and joking with his lawyers yesterday when they had to be there for jury questions. Can anyone verify this? D7?
by DocJ7/16/2015 10:44:34 PM
Do you think that the 2nd degree attempt to commit murder verdicts were for the victims in theater 8?
by MyraJ7/16/2015 10:44:35 PM
those 2 or 3 lesser counts were they the ones in theater 8?
by naturegurl7/16/2015 10:44:36 PM
I don't understand the lesser charge of murder in the second degree. How could they differentiate?
by Michelle Fletcher Carder7/16/2015 10:44:41 PM
2nd degrees are for people in theater 8
by Abrandt7/16/2015 10:44:42 PM
Woman near Century 16 just exclaimed "YES!" When I told her of the guilty verdict in the #TheaterShootingTrial

Why are there a handfull of 2nd degree guiltys?
by George7/16/2015 10:51:34 PM
@Angela--The kind of "help" Mr. Holmes can typically expect in prison, is just the kind of help he deserves.
by flip7/16/2015 10:51:35 PM
There are 24 murder counts for 12 victims. Each murder is being charged twice, under two different legal theories: "with deliberation" and "extreme indifference."
by Kathy7/16/2015 10:51:37 PM
@Abrandt; Thanks. That makes sense.
by FMM7/16/2015 10:51:38 PM
@Michelle Because he almost killed them with reckless disregard for his actions but they were not his direct targets.
by Abrandt7/16/2015 10:51:39 PM
Thanks for confirming @7 - that makes sense now.
by colo7/16/2015 10:51:39 PM
@7 News Why the second degree Guilty verdicts?
by Robin7/16/2015 10:51:40 PM
defense having to stand all this time must not be fun
by Brenda Cash7/16/2015 10:51:41 PM
JH doesn't care anymore about what happens to him. His "mission" was accomplished. He knows his life is over regardless of whether it's prison for life or death penalty. He doesn't care which is why he yawns, laughs, swivels in his chair. Will be no different during sentence phase. He is who he is. A mentally ill man.
by Danny7/16/2015 10:51:42 PM
1st degree murder is premeditated, planned and intentional. 2nd degree can be intentional but it is unplanned or not pre meditated.
by NH7/16/2015 10:51:43 PM
So how soon does the sentencing phase start?
by npc7/16/2015 10:51:43 PM
I applaud Judge Samour for his excellent knowledge of law and presiding of this trial..You Sir deserve a medal..
by Dennie Carp7/16/2015 10:51:44 PM
@lovelyrose Jury has tomorrow off and the 2nd part of the trial for the sentencing phase starts Monday. The jury will decide his fate
by Just Thinkin7/16/2015 10:51:45 PM
Be interesting to see if the verdict is Guilty Attempted M1 Extreme Indifference for theater 8 people too...will show this jury was really thinking!
