I think the 2nd degree charge may have been for someone in theater 8.

Because of his mental illness, not insanity, I think LWOP is the appropriate sentence. Although I am not against the death penalty.I hope he can stay on meds in prison.

I wonder if JH will begin have more videotaped psychotic breaks/outbursts in his prison cell, now that death penalty is on the table...(*whether they'd be real, as a result of the impact/stress of this verdict, or staged, as manipulation to appear "more escalated" in non-legal insanity)...Would that even be admissible evidence, any law experts out there...???

Since he has been determined that he is guilty there now will be a second trial to determine if he will spend life in prison or death penalty they will not determine that today.

There are 24 murder counts for 12 victims. Each murder is being charged twice, under two different legal theories: "with deliberation" and "extreme indifference."

JH doesn't care anymore about what happens to him. His "mission" was accomplished. He knows his life is over regardless of whether it's prison for life or death penalty. He doesn't care which is why he yawns, laughs, swivels in his chair. Will be no different during sentence phase. He is who he is. A mentally ill man.

1st degree murder is premeditated, planned and intentional. 2nd degree can be intentional but it is unplanned or not pre meditated.
