Theater shooting trial day 38: Dr. Woodcock to return to the stand, jail video likely to be shown

Dr. Jonathan Woodcock, the defense's expert, is going to return to the stand for the remainder of his cross-examination Friday. James Holmes' attorneys are also likely to screen for the jury another jail video showing the gunman in November of 2012, around the time that they say his mental health condition became aggravated in the jail.

@Ted DT has already come out and said that JH did this but that he was insane ... DT is trying to get him off under the insane plea!

@flip - I have no doubt that Brauchler is winning this fight atm, I'm just hoping that he doesn't go vicious with every defense witness and end up alienating jurors who are "sensitive" to what could be seen as bullying in a sense.

Depression is a mental illness, but it doesn't make someone homicidal. Ppl with ADHD tend to have issues with impulse control, yet they don't end up committing murder.

Remember, even the prosecution's doctors agree gunman is mentally ill. It is the legal assessment that matters in this case

@Hokie Pokie - Actually in CO it is the Prosecution's responsibility to prove he was not legally insane. In federal & most other state's laws it is the opposite.

@jward12--I think the cross of this witness was very well-calculated by the PT. I'm guessing the approach to Dr. Gur will be different, even though the main aim will be similar.

Yes, Dr. said JH was in a psychotic state during killing, hence insane. Yes, imagine B. bullying----seems to have a lot of energy to move meanings around.

Remember that in cross-examination the rules are slightly different and the prosecution is allowed to ask different forms of questions right now, unlike the limitations they had during their own witnesses

Let's see... he calls the psych line right before going into the theater, he surrenders immediately, and lists on a dating website, "Will you come visit me in prison?" Hmmmm... how can there be any doubt that he knew right from wrong and knew the consequences for his criminal behavior!

One can plan things for months even though you are insane. He was NOT getting proper treatment and his treatment team really dropped the ball on helping him.

The jury is very smart and watching all the evidence. They know that this doctor has seen less evidence then them. That he spend less time then this trial has lasted looking at evidence.
