Now discussing when/where in the instructions to define culpable mental state
Next is the sanity instruction Samour says
"prosecution must disprove beyond a reasonable doubt both of the above..." That references in the insanity prongs of culpable mental state or knowing right from wrong
Judge makes a record that defense is asking for instruction about commitment procedures. Last time we discussed this, they were asking for a much longer version. Judge says the reason this is allowed is to explain what happens in the event of an NGRI finding
@LorettaOstmann: We should get those around lunch today IF they fall under the ruling (I think they do...)
Rhetorical question from the judge: How much detail is appropriate? Judge says the goal is a "brief description" and he's only making minor changes to language
Judge says this language is the test for release if the defendant is committed due to an NGRI finding: "The defendant has no abnormal mental condition that would likely cause him to be dangerous to himself or others or the community in the foreseeable future..."
@LG: I cannot answer that at this time as my view is limited to the same view you are seeing. I suspect some are, as they have been every day... but I don't know at this moment
@shuffie: I know some viewers have their own Facebook group... but at this time our coverage plans are limited to the trial itself
@Victoria: That is correct. CMHIP is the most likely place he'd go... but that isn't guaranteed. The state would have the option to send him to another hospital if they think it would be better, but CHMIP is a very big and well-prepared institution
Judge Samour says Part B of the verdict forms asks if they found not guilty based on insanity... and they only answer Part B if they do not find guilt. This instruction he's reading is meant to clarify that a finding on one of those does not limit them to the same finding on other charges. So he could be found NGRI on some but not all. Also clarifies that they don't get to Part B of the form unless the "lesser included offenses" are also not guilty
@Utah: I can't say I've ever been inside, but I've driven through and around the campus. It appears to have both hospital buildings and others that look more like a jail with fences and security and such. It is a very huge campus
- Judge's Order

Judge strikes D291 as improperly filed, because it included both records and suggested rules
@NT8: Not at this hour... but I stand ready to do my best
We're going to have some time to take more questions during this recess... what do you want to talk about?
Got a lot of your questions to publish now, since I wasn't able to click approval on them while on set... here they come
