Theater shooting trial day 53: Start of the penalty process
Day 53 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, the penalty phase of the case begins. The jury found Holmes to be legally sane and therefore guilty when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colorado, movie theater and opened fire on the audience, killing 12 and wounding 70.
Does anyone remember Jennifer Seeger? Corbin Dates spoke about her, and she was doing lots of tv interviews after the event in 2012. i wonder why hasnt been a witness for the trial.

Note: if you are going to attend a movie... wear non-flip-flops... in case you need to flee.
by Cindy L7/22/2015 8:04:29 PM
What time does court resume?
by Fpsych7/22/2015 8:04:38 PM
I have moved over here from youtube. chat is out of control these days. Disgusting comments. Thank you 7 for all of your hard work through all of this and your teams efforts to deliver us quality up to date info on the trial!! -from all the loyal people watching since day one who aren't here to troll
by kellmonstr7/22/2015 8:04:51 PM
@Nadine, I personally believe the prosecution has proved all of these aggravating factors beyond a reasonable doubt. It comes down to the jury. It must be unanimous and if not, it's life in prison without parole. Who knows though...all of the evidence is there...
by Kels7/22/2015 8:05:23 PM
That's a great argument, Marsha. Wish Orman had made it.
by Tammy Garrison7/22/2015 8:05:28 PM
What does this verdict mean for King, Spengler, Brady, and the bunch?
by Nadine7/22/2015 8:05:33 PM
@Just Thinkin he had an automatic rifle, the fact that she was shot four times is no more indicative that he had the intent to kill a child for the reason they were a child as opposed ot a general intent to kill everyone.
by panda9117/22/2015 8:05:45 PM
You go, Kels!!! :) I know you'll get it done. We'll all be watching you in there one day (*although I hope not on something heinous and tragic like this...)!
by fascinated7/22/2015 8:05:53 PM
Did some research since days are blurring. Newsweek sent the tweet about the Jury Foreman FIVE DAYS AGO. So again, why did the Jury Foreman have to bring this up to the court?
by Just Thinkin7/22/2015 8:06:00 PM
No, Heather, he said he wanted to cause chaos so they couldn't get away from him and he could kill more people that way.
by Tammy Garrison7/22/2015 8:06:04 PM
@ Heather, You are no longer worth replying to IMHO. Your facts are truly distorted.
by NT87/22/2015 8:06:09 PM
That's the thing though, @CindyL...you shouldn't have to worry about fleeing in a movie theatre...so sad...
by Kels7/22/2015 8:06:14 PM
@Fpsych: 2:30 p.m. - court resumes
by Nadine7/22/2015 8:06:17 PM
Thanks for helping prove my point, kdsmith. You phrased it in a better way! :)
by fascinated7/22/2015 8:06:20 PM
Around 2:30 supposedly!
by Kels7/22/2015 8:06:23 PM
Seeger was not injured. Only injured victims had the opportunity to testify
by Fpsych7/22/2015 8:06:26 PM
Great question. 2:30, maybe? Next move is for jury for a verdict, isn't it?
by Tammy Garrison7/22/2015 8:06:28 PM
Just Thinkin, this was the first time the jury was back in court.
by Tammy Garrison7/22/2015 8:14:40 PM
@Cindy L - If you can bring yourself to even go into a theater!
by Just Thinkin7/22/2015 8:14:44 PM
@Kellmonstrr the good thing about this blog chat if you don't want to see the comments of others and only Channel 7's click on the gear shift and select remove comments!~ it's a beautiful thing!!
by LG7/22/2015 8:14:49 PM
I'm with you, NT8.
by fascinated7/22/2015 8:14:57 PM
@Just -- because they weren't in court again until today?
by Lynn7/22/2015 8:14:59 PM
Moving over from YouTube. Awful trolling! Thanks 7 for all your awesome coverage!
by Elizabeth Hale7/22/2015 8:15:02 PM
@Just Thinkin The Foremen brought it up to the court because the link was sent to him...
by LG7/22/2015 8:15:07 PM
Good afternoon! I completely forgot there was court today, can someone PLEASE give me a brief rundown on what happened today? Were their any witnesses? Thank you!
by imnotrealllyhere7/22/2015 8:15:12 PM
Is Phase 2 mitigation? While I dont think any evidence of the shooters qualities as a child will outweigh aggravating factors, I am interested to hear from the parents. These mitigators will be akin to the 'insanity' evidence in Nov of 2012..
by debitwo7/22/2015 8:15:19 PM
I heard the JH was found in a drugged condition in the car..he could not even stand up for the mugshots at the Police station......huh ?...witnesses saw accomplices at exit door ...huh ?
by Sunrise77/22/2015 8:15:21 PM
Please everyone that's been here don't fall into the traps of the odd, strange and random comments that have appeared today to just cause issues... :)
by LG7/22/2015 8:22:14 PM
@LG - I know why the Foreman brought it to the courts attention, but why did no one else do the same?
by Just Thinkin7/22/2015 8:22:17 PM
@panda911 The rifle was a semi auto not an automatic. Their is a major major difference.
by Mark7/22/2015 8:22:21 PM
@panda911 - You and I can just disagree on the point. Children attend movies in theaters all the time and he took that into consideration ALL THE TIMES HE VISTED THE THEATER PRIOR TO HIS CRIME.
by Just Thinkin7/22/2015 8:22:27 PM
@sunrise7 Wrong, he gave up when confronted by an armed police officer. Gave up like the coward he is.
by NT87/22/2015 8:22:31 PM
Lol "aggravating actors."
by Malingering7/22/2015 8:22:39 PM
Jeez i'm done with the Youtube chat too
by Goliath_Fish7/22/2015 8:22:43 PM
Is that like, Tom Cruise?
by Malingering7/22/2015 8:22:44 PM
@sunrise7 --- wrong!
by Pcmamanim7/22/2015 8:22:50 PM
Maybe King and the four sob sisters could take a trip to Penn. and Gur could take them out for an expensive lunch after all she collected about half a million for her pathetic performance.
by JW7/22/2015 8:22:53 PM
deb, yes.imnotreallyhere, DT through a fit over the slideshow PT gave them just last night with a bunch of objections to screens, the instructions were read to the jury, and the jury foreman informed the judge that his name was published by newsweek.
by Tammy Garrison7/22/2015 8:22:56 PM
@ sunrise7. I saw that but I think that was the conspiracy theory. People have said it was him because his father was going to whistle blow on a big co I think. not people on here I might add
by Aly7/22/2015 8:23:06 PM
@Sunrise7 - you mustve been reading one of those ridiculous conspiracy theories out there that say the government drugged him and he didn't do it or some other such nonsense.
by colo7/22/2015 8:23:11 PM
Can we just get the conspiracy theory crap out of here? The comments here have just been far too intelligent to lower it to that level. Please.
by Marsha Laurienti7/22/2015 8:23:15 PM
Jurors have a right to remain anonymous (not a surprise that some chose to do so given the strong feelings people have in certain cases) others opt to talk with the press post trial. Newsweek took that choice away from the foreman aside from breaking thecourt's order. Today was the first day back and first opportunity for the foreman to express his concern.
by Edy7/22/2015 8:25:24 PM
@Tammy Garrison Thank you, that helps a lot.
by imnotreallyhere7/22/2015 8:25:27 PM
@Sunrise7 Conspiracy theories like this are insults to the victims, and entirely lacking factual basis. I rarely comment on anything, I'm sure this is a trolling thing, but I legitimately can't stomach the bored people who create offensive theories to capitalize on tragedy and fill their time.
