Theater shooting trial day 53: Start of the penalty process
Day 53 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, the penalty phase of the case begins. The jury found Holmes to be legally sane and therefore guilty when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colorado, movie theater and opened fire on the audience, killing 12 and wounding 70.
Does anyone remember Jennifer Seeger? Corbin Dates spoke about her, and she was doing lots of tv interviews after the event in 2012. i wonder why hasnt been a witness for the trial.

@Nadine, I personally believe the prosecution has proved all of these aggravating factors beyond a reasonable doubt. It comes down to the jury. It must be unanimous and if not, it's life in prison without parole. Who knows though...all of the evidence is there...

@Just Thinkin he had an automatic rifle, the fact that she was shot four times is no more indicative that he had the intent to kill a child for the reason they were a child as opposed ot a general intent to kill everyone.

Did some research since days are blurring. Newsweek sent the tweet about the Jury Foreman FIVE DAYS AGO. So again, why did the Jury Foreman have to bring this up to the court?

Is Phase 2 mitigation? While I dont think any evidence of the shooters qualities as a child will outweigh aggravating factors, I am interested to hear from the parents. These mitigators will be akin to the 'insanity' evidence in Nov of 2012..

deb, yes.imnotreallyhere, DT through a fit over the slideshow PT gave them just last night with a bunch of objections to screens, the instructions were read to the jury, and the jury foreman informed the judge that his name was published by newsweek.

Jurors have a right to remain anonymous (not a surprise that some chose to do so given the strong feelings people have in certain cases) others opt to talk with the press post trial. Newsweek took that choice away from the foreman aside from breaking thecourt's order. Today was the first day back and first opportunity for the foreman to express his concern.
