Theater shooting trial day 53: Start of the penalty process
Day 53 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, the penalty phase of the case begins. The jury found Holmes to be legally sane and therefore guilty when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colorado, movie theater and opened fire on the audience, killing 12 and wounding 70.

@DocJ...I am not sure under CO law...typically, a Life Sentence states a minimum (like 30 years) to life...so he'd have to serve 30 years to be considered for parole...with good behavior it might be 25...this is a good question for the CO lawyers on abc7

@Frank...I'm not so sure. 'Planning, planning, planning...history of the case/evidence shows more manipulation than true mental illness. I actually think DP is very plausible-'especially with this jury. They didn't buy insanity. But we'll see...

4 Pictures of little Veronica, and they object as it is prejudicial. Hmmm. JH should be required to have a picture of her, and her autopsy tattooed on his arm so he can be reminded everyday of what he did. Ya know, Capone insisted the ghosts of all the people he killed were haunting him and driving him crazy.

@kat, I know what you mean. Her voice makes me feel nervous. However, I have to admire her in that she would have to know how her abnormality sounds to an audience. Makes her sound like she has stage-fright. She had to overcome a lot in order to be a lawyer, whose job it is to talk in open court.

@Edy - I must respectfully disagree with you on the point that the defendant's parents bear any responsibility with the defendant's actions. He is a grown man, capable of making his own decisions and old enough to bear the weight of the consequences of his actions. In my opinion, the defendant bears sole responsibility for this crime.

The DT is doing their job although because of the tweet Brauchler sent out being admitted as an exhibit it just appears that Brady and Brauchler "lock horns" over every little thing.

Her voice sounds like she's extremely nervous. Not someone I'd want fighting on my behalf. And she's using that voice to whine about the victims pictures being shown more than once. They should enlarge every victims photo and hang it around the courthouse. This is about them and they should be in that courtroom too.
