Theater shooting trial day 53: Start of the penalty process
Day 53 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, the penalty phase of the case begins. The jury found Holmes to be legally sane and therefore guilty when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colorado, movie theater and opened fire on the audience, killing 12 and wounding 70.
I hate my keyboard. I am a literature professor, yet I leave words out of sentences. My post to Nadine should have read, "It happened after the verdict was given."

Tammy - I'm with you...curious about which video- maybe Dr. Reid's, (?) when shooter describes wanting to keep victims inside theater, describes "collateral damage", saying he'd shoot if they surrendered, watched specific people try to flee & then shot at them?? Maybe?

I'm confused, I thought the DT had witnesses that could only testify today? this week? and then not until August. But then we had all those objections. Can somebody provide a likely scenario of the timeframe as to when witnesses will testify? I though I was paying attention . . .

@Fascinated I seriously have no idea what you are talking about. Haven't change my name nor intend to. I meant I have issues that it was the juror that had to bring up the issue to the court and it was a WELL KNOWN FACT WITHIN THE MEDIA and even the COURT what happened with newsweek last week but NO ONE made it an issue until the Jury Foreman did. So if you serve on a jury beware the court wont protect you until you ask them too!

@fascinated - I dont believe Dr. Reid's videos would be allowed since these were allowed in the trial for the limited purpose of the insanity defense. Which I believe they said this morning were now not allowed to be considered since there is no longer a defense of insanity...

The judge got a little annoyed with the DT yesterday about the witnesses they wish to call. The judge has the authority to enforce their subpoenas no matter what their schedules are. The DT did not ask the judge to do so, but is asking the court to schedule around the witnesses personal schedules.

I think we should all be very careful on here to not exacerbate the situation by hinting who the juror is. I don't want to know and we certainly don't want channel 7 being subject to questionable ethics.

I personally think we should give the jury foreman his privacy...and not post personal details about him on here, etc. His voice was shaking when he addressed the judge about it. :/ Otherwise, we're just as bad as Newsweek- in a way. I wouldn't want to be scrutinized like that...
