Theater shooting trial day 53: Start of the penalty process

Day 53 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, the penalty phase of the case begins. The jury found Holmes to be legally sane and therefore guilty when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colorado, movie theater and opened fire on the audience, killing 12 and wounding 70.

@CSP... I agree with your comment except there will be appeals done in this case for sure especially if he get DP that's just the nature of the beast... her tone of voice has bearing on it!!

as far as JH reading documents, I havent seen the DT give him anything to look at during the trial except the last 2 days

@TLR- evidence from trial is different from evidence in the sentencing phase. There a different rules based on case law, not just the DT trying to be aggravating to you.

Well I think he's angry, and rightly so. Even though the judge is upset about the timeliness of this presentation, I bet he rules for Orman more most of these slides.

@marsha they're actually setting up more reasons for appeal. every objection made can be used for an appeal. that's why they make records half the time. it doesn't really matter though, death penalty appeals are nearly inexhaustible.

@Frank, I don't think he will be housed in Sterling, but probably CSP.- All of Colorado's death penalty inmates are housed in ad-seg at the Sterling facility. One week before the execution date (after the governor has signed the death warrant) the inmate is moved to the Colorado State Penitentiary, which houses the execution suite (yes, that's what they call it- the Execution Suite).

As much as I get exasperated by the DT and all of their objections, remember future courts will be referring to this case, all of the arguments being made, the ruling the judge makes and what an appellate court reviews about the case. Future cases will depend on this one for guidance and how they proceed. It may be laborious but it is necessary!

Whether they are pathetic, which I agree they were pretty bad, they still have to do this. It gets annoying to see all the complaining as if the monster isn't allowed a defense. They aren't bad people because they defended him, they are doing their job.

If JH gets the DP, he will be housed in the Sterling Facility, until 1 week before he is put to death..which I am sure will be decades from now. If he gets LWOP, not sure where he will go.
