Theater shooting trial day 53: Start of the penalty process
Day 53 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, the penalty phase of the case begins. The jury found Holmes to be legally sane and therefore guilty when he went into the midnight premiere of the Dark Knight Rises in an Aurora, Colorado, movie theater and opened fire on the audience, killing 12 and wounding 70.
@CSP... I agree with your comment except there will be appeals done in this case for sure especially if he get DP that's just the nature of the beast... her tone of voice has bearing on it!!

Why does he have to be so condescending and sarcastic? It's not necessary.

JH thinks Ormans tone is "too personal" so GO ORMAN!!!!

Listen to Orman JH!!!!!!
by Kristle7/22/2015 3:53:32 PM
HIS voice grates on my nerves.
by wp7/22/2015 3:53:33 PM
as far as JH reading documents, I havent seen the DT give him anything to look at during the trial except the last 2 days
by emma7/22/2015 3:53:50 PM
@TLR- evidence from trial is different from evidence in the sentencing phase. There a different rules based on case law, not just the DT trying to be aggravating to you.
by CSP7/22/2015 3:53:52 PM
If Ormans words haunt JH in his cell then GO ORMAN!!!
by Kristle7/22/2015 3:53:55 PM
why do I keep loosing the feed?
by Mary jo7/22/2015 3:54:09 PM
Well I think he's angry, and rightly so. Even though the judge is upset about the timeliness of this presentation, I bet he rules for Orman more most of these slides.
by Tammy Garrison7/22/2015 3:54:43 PM
Holy crud...didn't they do all this over the past two days? This is very disrespectful to the jury.
by litprof7/22/2015 3:54:44 PM
@marsha they're actually setting up more reasons for appeal. every objection made can be used for an appeal. that's why they make records half the time. it doesn't really matter though, death penalty appeals are nearly inexhaustible.
by blue7/22/2015 3:54:47 PM
Orman is aggrevated over the Aggrevating factors!!!
by Tired7/22/2015 3:55:56 PM
Marsha, they're still pretty pathetic at their jobs...seriously...pathetic
by AM7/22/2015 3:55:58 PM
@Frank, I don't think he will be housed in Sterling, but probably CSP.- All of Colorado's death penalty inmates are housed in ad-seg at the Sterling facility. One week before the execution date (after the governor has signed the death warrant) the inmate is moved to the Colorado State Penitentiary, which houses the execution suite (yes, that's what they call it- the Execution Suite).

As much as I get exasperated by the DT and all of their objections, remember future courts will be referring to this case, all of the arguments being made, the ruling the judge makes and what an appellate court reviews about the case. Future cases will depend on this one for guidance and how they proceed. It may be laborious but it is necessary!
by Just Thinkin7/22/2015 3:57:32 PM
@AM How are they pathetic at their jobs?
by panda9117/22/2015 3:57:38 PM
Whether they are pathetic, which I agree they were pretty bad, they still have to do this. It gets annoying to see all the complaining as if the monster isn't allowed a defense. They aren't bad people because they defended him, they are doing their job.
