Theater shooting trial day 56: 'Phase 2' of the penalty process continues

'Phase 2' of the penalty process continues in the trial of James Holmes for the Aurora movie theater shooting. He was convicted earlier this month on 165 counts and now his defense is presenting mitigating evidence in an attempt to convince the jury his life should be spared.

My memory is that the judge did address this issue with the jury in his instructions by referring to "any other similar event" in the news.

Judge Samour asks if jurors were exposed to coverage of Louisiana movie theater shooting. Jurors 17, 329, 661, 87, 1009, 118, 155, 673, 706, 737, 307 and 557 all said yes.

It just seems weird (like I said Friday) that the DT didn't talk about this Friday. King brings up the juror wearing a t-shirt that he was concerned about. But nothing about the shooting. And we know that Brady keeps up with social media.

Good Morning everyone! I missed the last half of friday. Did I miss anything interesting with the defense's witnesses? Was it all still just teachers or did anyone from his family speak? The PT didn't start their victim impacts yet did they?

Pretty crazy this really as arent most crimes a copycat one of a previous crime so shall we never prosecute a crime again ?

Juror 329 said her exposure to media coverage was very brief. She said she "heard 'theater' and 'shooting' and left the room." Says she can still be impartial.

For me personally, it's a different case, in a different state, under different circumstances. It should have no impact at all and this is a waste of time.

FYI: 7 jurors that said they heard of the case were/are deliberating jurors and 5 jurors were/are alternates. Just in case in anyone wanted to know!
