Day 61 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, prosecutors will call family members of the 12 victims who were killed.Jurors have already confirmed they found aggravating factors in the mass shooting for which they convicted the gunman. They also confirmed that any mitigating factors that might exist do not outweigh the aggravating factors. This round of testimony is the third and final phase before jurors decide on the death penalty.Holmes was convicted on 165 counts including murder and attempted murder for the shooting that killed 12 and injured 70 others during a midnight premiere of the Dark Knight Rises in Aurora, Colorado. Hearsay is an out of court statement offered to prove the matter asserted. So a witness' own statement can definitely be hearsay.

is anyone else sick of hearing the DT say "he didn't ask for this mental illness" i didn't ask for an alcoholic father or a sister who suffered from severe depression but that's life you deal with the problems you are given and he chose not to get help

Higgs opening statement for this phase was offensive to the victims and their families. If I were on the jury I would have been nauseated.

I know DT has to do their job but to me, PT has been so much more reserved, diplomatic and tactful. DT is overblown, exaggerated, often baseless & melodramatic. This is the victims & survivors time. I want DT to sit down and shut up. I realize they can't always, but they are scoring NO POINTS w/the jury, in my view. It's pretty remarkable when PT has to withhold testimony due to cause of jury getting too emotional...Yet DT exaggerates & shooter makes up stories and researches insanity laws in CO state, simply to try to squeeze a drop of emotion. 'Jury gets it. I have faith in them ('can't say that for Higgs' acting career, though). She says "he didn't "CHOOSE" mental illness. 'Beg to differ, Ma'am. He researched a menu of legal mental illness possibilities, (yes, it's in the record) then he selected one major illness - schizophrenia, plus a few accompanying conditions to make it complex (like hair pulling-'never saw an ounce of evidence for that BS), & of course, symptoms to accompany. I LOVE that the jury isn't buying what Jimmy & DT are selling. 'Just wish it weren't too late for the victims.
