Day 61 in the Aurora movie theater shooting trial – People vs. James Eagan Holmes. Today, prosecutors will call family members of the 12 victims who were killed.Jurors have already confirmed they found aggravating factors in the mass shooting for which they convicted the gunman. They also confirmed that any mitigating factors that might exist do not outweigh the aggravating factors. This round of testimony is the third and final phase before jurors decide on the death penalty.Holmes was convicted on 165 counts including murder and attempted murder for the shooting that killed 12 and injured 70 others during a midnight premiere of the Dark Knight Rises in Aurora, Colorado. @jacob w--There is even some evidence that he purposely chose to play the CU psychiatrists he visited in order to construct the foundations of an insanity defense before committing his horrible crimes. He gave them just enough information to suggest that he was seeking help for mental illness and then he consciously chose to hide his detailed murder plans so they wouldn't be able to stop him. Really hope this jury has the strength and clarity to give this piece of worthless garbage the death penalty.

Apparently Jared Loughner, once properly medicated (note: all his delusions weren't dispelled), cried when he realized he'd killed Christina Taylor Green (6 years old, just like the youngest victim at the Century 16) -

IMO, after witnessing all of the DT objections I am convinced they are in full appeals mode. They already know they've lost the jury. Perhaps if the jury had taken longer to come back with either of their verdicts they would be strategizing differently. The jury is making decisions together to quick to be anything but a cohesive unit and the DT has no other reason for them to believe otherwise.

Eric-good question. He seemed to smile a bit when jury was out/laughed, etc. Never seen nor heard of any grief. 'Mentioned remorse, but we don't know if that's for himself or victims. My bet is himself. I'm sure defense will tell us how sorry he is-despite his robot act.

@BluesB, I agree with you on the professional decorum of the attorneys however, I will say that in the beginning of the PT case, I did not like that the female PT attorneys touched by way of guiding the witness to the stand for testimony or hands on the back guiding them out. -

The DT is certainly skilled, but their strategy was off and they were tone deaf about it. So they did not make adjustments as the jury was definitely not buying what they were selling. That was clear from the beginning, but painfully so during phase 2. So now they still have no ability to adjust with the flow, they seem totally adrift with the only idea seeming to be fake crying and lecturing/warning the jury.

@Tired, Looking back at your comment about how Mr. S.'s testimony makes you want to be a better father, maybe that is another legacy of the victims, survivors and their families- to inspire us all to try to do things a little better . I'm grasping for positives, because none of this is logical.
