I've never had a defense lawyer push me into the PT camp before. Never. This whole DT has done nothing but push me into PT camp since the little Jimmy show started.

Mental institution is Out. They ruled him sane. He can smear a 70 lb. BUCKET full of feces & he still gets death or LWOP.
by BluesB 8/6/2015 9:42:44 PM
I think they would make a decision today but it will take longer than they have available today just to complete the paperwork
by Sue8/6/2015 9:42:47 PM
I'm still in shock that she actually said the victims 'were just some people'!
by Sophia8/6/2015 9:42:51 PM
I wouldn't be surprised if all the attorneys are about to have a three martini afternoon break.
by Lynn8/6/2015 9:42:55 PM
Insanity was proven, but the jury didn't get it the field is extremely limited in James kind of mental illness, in part, because someone wants to kill rather than learn Otly a couple of the docs were researchers, but all did agree psychotic and severely mentally ill. the law of insanity is very subjective and then the jury rolled with who they are are people, which weighted more with their emotional minds, rather than intellectual
by yourneighbor8/6/2015 9:43:04 PM
for what reason would the jury ever want the ammunition?

Whenever, Phil. How you've handled all this with fewer than two brains and four hands is beyond me.

Thank you Phil, Anica and Marshall you have been great!!
by ERICA8/6/2015 9:43:16 PM

but i still think he should get the DP
by nofordp8/6/2015 9:43:20 PM
Phil - nice work! I know you guys weren't expecting things to come to a close so quickly. You did a great job at picking up the baton and running with it.
by kate8/6/2015 9:43:22 PM
It is very quite in here. Thoughts anybody??
by tmt8/6/2015 9:43:23 PM
What point is Barrachler making by yelling at the jury?
by Rick S8/6/2015 9:44:08 PM
I've got to take a few moments to finish updating this story about what just happened. Let me know what quotes you think I should include?
7NEWSShould James Holmes be put to death by lethal injection? Twelve jurors are now considering that question.

@notfordp -- Yes. Even the prosecution experts said he is mentally ill. We should not execute the mentally ill in this country.

I'm with @Sophia... no remorse = no mercy
by caz8/6/2015 10:09:43 PM
How long do you guys think it will take the Jury to decide in this phase? They've been pretty quick with their decisions thus far.
by Proph8/6/2015 10:09:45 PM
The jury has the case and will be right back. As soon as they get the forms signed.
by Resa8/6/2015 10:09:56 PM
Well, juror 118 might still make it to her son's graduation....

I think Mr. Brauchler is a brilliant strategist--by passing on rebuttal he effectively conveyed to the jury: This is a no-brainer.
by flip8/6/2015 10:10:03 PM
@Phil, you keep that place running! :-)

If I was a juror, I would not take it personally or let it define my morals to issue the DP, it is not I who kills him, it is his crime that does.
by Resa8/6/2015 10:10:08 PM
insanity was proven, but jury didn't get it. testimony was complex and the nature of it's subjectivity might have deterred into the certainty of their emotional state, although that was not be considered. Problem when a jury is chosen because they support the dp
by green chair8/6/2015 10:10:12 PM
Brauchler was smart not to rebut. Left the jury with that truly awful DT argument as last thing they heard.
by Sophia8/6/2015 10:10:15 PM
By passing on rebuttal, Mr. Brauchler is also clearly saying to the jury: "I trust your ability to understand all of this and render the correct decision"
by flip8/6/2015 10:10:18 PM
Dan, if the mental illness argument did not work for the defense in Phase 2, why did Brady focus so much of her Phase 3 closing on that? Should she have focused more on the morals of each juror?
by WSLC8/6/2015 10:10:21 PM
Always on this forum, some thoughtful, knowledgable, informed and civil people with insights that illuminate opposing opinions. To those folks, and to the crew at D7, many thanks.

My comment thread crashed during Brady's choke, (irony?) but thanks for the therapeutic humor & simultaneous on-point remarks, Flip, Sophia, Suzanne, & lots of others...DP is a given, IMO. Jury didn't react well to Brady's pointing guilt trip last time. Don't think they lile being lectured. They see RIGHT THROUGH The Swiveler.
by BluesB 8/6/2015 10:10:45 PM
For Dan, I thought the judges instructions said that there was no burden of proof for either side in this phase of the sentencing hearing..
