Jurors will come face to face with the ultimate question in the Aurora movie theater shooting trial: Should James Holmes be put to death by lethal injection?
I've never had a defense lawyer push me into the PT camp before. Never. This whole DT has done nothing but push me into PT camp since the little Jimmy show started.

Insanity was proven, but the jury didn't get it the field is extremely limited in James kind of mental illness, in part, because someone wants to kill rather than learn Otly a couple of the docs were researchers, but all did agree psychotic and severely mentally ill. the law of insanity is very subjective and then the jury rolled with who they are are people, which weighted more with their emotional minds, rather than intellectual

If I was a juror, I would not take it personally or let it define my morals to issue the DP, it is not I who kills him, it is his crime that does.

insanity was proven, but jury didn't get it. testimony was complex and the nature of it's subjectivity might have deterred into the certainty of their emotional state, although that was not be considered. Problem when a jury is chosen because they support the dp

By passing on rebuttal, Mr. Brauchler is also clearly saying to the jury: "I trust your ability to understand all of this and render the correct decision"

Dan, if the mental illness argument did not work for the defense in Phase 2, why did Brady focus so much of her Phase 3 closing on that? Should she have focused more on the morals of each juror?

My comment thread crashed during Brady's choke, (irony?) but thanks for the therapeutic humor & simultaneous on-point remarks, Flip, Sophia, Suzanne, & lots of others...DP is a given, IMO. Jury didn't react well to Brady's pointing guilt trip last time. Don't think they lile being lectured. They see RIGHT THROUGH The Swiveler.

For Dan, I thought the judges instructions said that there was no burden of proof for either side in this phase of the sentencing hearing..
