Theater shooting trial day 64: The life-or-death verdict for James Holmes
NOTE: This video is a placeholder, waiting to begin until the three-hours warning is issued by the court that a verdict was reached. Will James Holmes be put to death by lethal injection for the 12 people he killed inside an Aurora, Colorado movie theater? Or will the jury send him to prison for the rest of his life?Jurors are about to come face-to-face with the ultimate decision in the Aurora movie theater shooting trial: "Should James Eagan Holmes be put to death by lethal injection?"Jurors have already confirmed they found aggravating factors in the mass shooting for which they convicted the gunman. They also confirmed that any mitigating factors that might exist do not outweigh the aggravating factors. Holmes was convicted on 165 counts including murder and attempted murder for the shooting that killed 12 and injured 70 others during a midnight premiere of the Dark Knight Rises in Aurora, Colorado. His defense attorneys unsuccessfully argued that he was insane at the time of the shooting. 7NEWS and TheDenverChannel.com will have gavel to gavel coverage of the trial starting at 8:30a.m. (MST) everyday and ending around 5:30 p.m. (MST) Watch new live video on our YouTube channel: http://www.youtube.com/user/7NewsDenver/live Additional resources:LIVE VIDEO & BLOG: http://bit.ly/theatertrialTIMELINE of the case: http://bit.ly/theatertimelineJURY PROFILE: http://bit.ly/theaterjury CONTINUING COVERAGE: http://bit.ly/theatercoverage

He only needs one, right? One count with unanimous death, correct?
by LoriJ8/7/2015 8:29:50 PM
Maybe ask us bloggers what we think it will be?
by Nadine8/7/2015 8:29:51 PM
Hi Phil & everybody

My prediction: Death for Holmes
by Resa8/7/2015 8:29:53 PM
Is it just me that noticed Brady's outfits have contained prison stripes yesterday & today?
by LoriJ8/7/2015 8:29:54 PM
will the media still be barred from talking to the jurors after the verdict is read meaning when they exit the building
by DeathisJustice8/7/2015 8:30:00 PM
Hi everyone!
by caz8/7/2015 8:30:02 PM
Wow! That was pretty fast.
by vt8/7/2015 8:30:03 PM
@Phil and D7; thank you for a job well done.
by Resa8/7/2015 8:30:03 PM
If I understood the judge correctly yesterday all it takes is for the jury to unanimously find him guilty on 1 count for the DP, even if the other counts are not unanimous?
by AW8/7/2015 8:30:05 PM
Thank you to the jury, no matter the decision. Was a difficult task.
by Resa8/7/2015 8:30:06 PM
Does anyone think this means death? 6.5 hour deliberation
by clh8/7/2015 8:30:09 PM
Man...anyone want to guess what it'll be? X-|
by Loz8/7/2015 8:30:10 PM
hope its not lwop
by DeathisJustice8/7/2015 8:30:10 PM
So the gory crime scene video they requested helped seal the deal.
by CO newbie8/7/2015 8:30:12 PM
Wow that was fast. I thought it would be, but not sure what that will mean???
by Suzanne8/7/2015 8:31:05 PM
I have chills!
by Sarah8/7/2015 8:31:06 PM
My sister worked with his sister at Cold Stone
by DeathisJustice8/7/2015 8:36:23 PM
So is he getting DP or not sentenced yet
by Dale K8/7/2015 8:36:24 PM
As a mother, I cannot imagine what the Holmes' family is feeling right now. This is not to take anything away from the victims but they must be in a complete panic.
by MW8/7/2015 8:36:36 PM
@Suzanne I know, I can't decide whether the time taken is a good thing or a bad thing.
by DeathisJustice8/7/2015 8:37:27 PM
I'm already suffering withdrawal from this blog!
by Suzi Lewis8/7/2015 8:37:37 PM
I believe that the experts have said that the sooner the jury comes back, the more likely the decision would be DP
by vt8/7/2015 8:37:40 PM
@AW - I thought I heard that too but I just assumed that I heard it wrong.
by Suzanne8/7/2015 8:37:41 PM
Bet there were just a couple jurors who leaned toward LWOP, but were still on the fence. Maybe they requested the video to help push them toward a DP verdict.
by kate8/7/2015 8:37:42 PM
Wow that was so fast!
by RRose8/7/2015 8:37:43 PM
May have to watch the verdict on my phone, my computer at home is overly antiquated(2003) and can't keep up with streaming
by Death_is_Justice8/7/2015 8:37:45 PM
@ Resa - agreed! The jury did a great job!
by Suzanne8/7/2015 8:37:46 PM
No matter what the verdict is, I have the utmost respect and admiration for these jurors and the difficult job they had to do.
by Suzi Lewis8/7/2015 8:37:47 PM
Here's a link to the Phase 3 instructions and verdict forms: bit.ly
by Phil Tenser8/7/2015 8:42:02 PM
Even if it's the DP he will live many many years in prison for appeals
by TLR8/7/2015 8:42:09 PM
@MW I too have felt so sorry for his family. He destroyed so many families including his.
by Death_is_Justice8/7/2015 8:42:11 PM
This guy is obviously not incompetent. I would think someone who committed a violent crime during a psychotic episode would show some sort of remorse once he's realized what he's done.
by AW8/7/2015 8:42:13 PM
if he gets DP how long do people predict it will take before it is carried out?
by djs8/7/2015 8:42:14 PM
I can't imagine what the victims and their families are going through. In a way, his parents and sister are victims too. No one wins in this situation, regardless of the sentence
by Amber8/7/2015 8:42:16 PM
My thoughts are with the families & friends of the 12 victims, the survivors, and all of the people whose lives were impacted by this horrible crime. Regardless of the sentence, I hope they all sleep a little better tonight.
by Puglove8/7/2015 8:42:18 PM
@ Suzie yes!
by emma8/7/2015 8:42:19 PM
Kind of crazy to think all this is going to be over tonight. It was great getting to know some of you, learning about the trial process, and debating points of view.
by Saira8/7/2015 8:42:20 PM
Did anyone else see the about face Brady when the jury requested the theater video? She first agreed with the prosecution that she had no objection to their request. Then, thinking about it while discussing it, she decide that she didn't want them to look at it. I think the violence and gore in it underscored the horrendous, planned slaughter of innocents.
by Suzi Lewis8/7/2015 8:42:22 PM
See you soon, Jimmy... braahhhahhahaha
by G. Reaper8/7/2015 8:42:23 PM
So once the trial is over, are the jurors then allowed to speak with the media? Phil, do you think they will?
