Theater shooting trial: Non-capital sentencing hearing

James Holmes will learn his punishment for 141 other crimes tied to this case in a hearing that begins Monday; these crimes include the charges for explosives planted in his apartment.Victims, families and the gunman will have another chance to address the court, similar to the other sentencing phase. The key difference is that there will be no jury in this hearing and the sentencing decisions will all be made by the judge.

The parent's did not do this. She sounded sincere and it does have to hurt her, no one would ever want to go through her position just like they wouldn't want to go through the victim's positions. I don't find it in me to attack them because their son is vile animal. I hope they find some clarity in their lives just like I wish the same for the victims.

I feel sorry for Mrs. Holmes, and I can see that she must believe that her Monster of a son is sick and not evil, but she needs to stop telling people that they need to understand it's not his fault. It is and she needs to accept it.

I am not a Brauchler fan. His showmanship is the equivalent to really bad acting. All the money he wasted to keep his name on the news. Worst DA ever for Arapahoe County. He enjoyed every minute of his charade. Just my honest opinion.

If there was a death penalty, yes, they set up for appeal. Since death penalty is off the table, they know they would never win an appeal to set him free because he admitted to all of his charges, mental illness or not. They cannot appeal for him to be placed in a hospital, the jury already threw out the insanity.

Maybe a better way to state it is that "the defense won't seek AN IMMEDIATE appeal". They may still appeal at a later date.
