APD Officer Oviatt said he was about 20 feet away from James Holmes and pointed his gun at him. Officer Sweeney was behind Oviatt and ordered Holmes to show his hands.
APD Officer Oviatt: "As I got closer to the car I noticed the person wasn't acting like a cop. All the other officers were trying to find a way into the building... and this person was just very relaxed, standing by the car, doing nothing at all."
APD Officer Oviatt said he had heard the call for officers to use gas masks so it didn't surprise him to see someone in a mask there.
APD Officer Oviatt: "He was wearing a tactical helmet and a gas mask."
APD Officer Oviatt: "There was a car... a white 2-door... There was a person standing on the opposite side of the car from me. He was wearing tactical gear... at first I thought he was another officer."
APD Officer Oviatt said he followed the trail of blood, looking for a way to get into the theater. At the time he thought someone was still shooting and said he wanted to get inside to stop the threat.
APD Officer Oviatt: "There was blood along the sidewalk leading back towards the theater."
APD Officer Oviatt said Officer Sweeney was the only officer he saw when he arrived behind the theater, there were more approaching from the front.
APD Officer Oviatt: "Officer Sweeney was there and there were two people who were bleeding."
APD Officer Oviatt: "I drove up over the curb and parked on the lawn." He pulled up right behind the theater.
BACKGROUND INFORMATION APD Officer Jason Oviatt: Was the first officer to arrive and one of those who handcuffed Holmes outside the theater along with Officer Sweeney. They took him into custody and asked if anyone else was involved, to which Holmes allegedly replied "it is just me." Oviatt also asked if the address on his license was correct, and Holmes replied that it was but there were bombs with trip wires inside the apartment, according to the arrest affidavit.

Juror 706 said: "As I came up the ramp from security... there's this tall fellow, he's tall and slender, wears a suit... a little unshaven, it looks good on him." She says she's not 100% sure about whether he had a media badge.
